Warranty - RUSH WAVE

1. WARRANTY COVERAGE

RUSH WAVE warrants its new products against defects from manufacturing under normal operating conditions and when used in accordance with the applicable owner's manual and safety instructions.

For the purposes of this warranty, the "Original Owner" means the person or entity that originally purchased the product from RUSH WAVE or an authorized RUSH WAVE retailer, as evidenced by the original invoice or proof of purchase.

This warranty may be transferred to a subsequent owner, provided that the new owner can provide a copy of the original invoice or other valid proof of purchase. The transfer does not restart or extend the original warranty period.

Warranty Period

  • Electric surfboards and electric karts: 2 years from the date of delivery to the original customer.
  • Products used for commercial, rental, demonstration, or other income-generating purposes: 1 year from the date of delivery.
  • Accessories: 2 years from the date of delivery, unless a different warranty period is specifically stated for the accessory.

This warranty covers manufacturing and material defects affecting the electrical and mechanical components of the product, subject to the exclusions and conditions described below.

The warranty period will not be extended because of downtime resulting from inspection, repair, replacement, demonstration, rental return, transportation, or any other service-related activity.

Parts repaired or replaced under warranty will be covered for the remaining duration of the original product warranty period.

Any defective part must be retained and made available to RUSH WAVE for inspection. If RUSH WAVE requests that a defective part be returned and the customer fails to return it within the requested timeframe, the warranty claim may be denied.

2. RUSH WAVE'S WARRANTY OBLIGATION

RUSH WAVE's obligation under this warranty is limited, at its discretion and subject to applicable law, to:

  • Repairing the defective product or component;
  • Replacing the defective product or component with a new or equivalent component; or
  • Providing another appropriate remedy permitted by applicable law.

Warranty repairs may be performed at RUSH WAVE's facilities or through an authorized RUSH WAVE retailer or service provider.

RUSH WAVE reserves the right to use equivalent or updated replacement components when repairing a product.

RUSH WAVE may introduce improvements, modifications, or changes to its products at any time. RUSH WAVE is not obligated to retrofit previously sold products with such improvements or modifications. Where appropriate, RUSH WAVE may offer such modifications or upgrades at the customer's expense.

Unless expressly agreed otherwise in writing, this warranty does not guarantee a specific level of performance, speed, range, operating time, productivity, or suitability for a particular application.

3. WARRANTY EXCLUSIONS

This warranty does not cover normal wear and tear, cosmetic deterioration, maintenance items, or consumable components.

Without limitation, warranty coverage does not apply to damage, defects, or failures resulting from:

  • Normal wear and tear or cosmetic damage that does not affect the functionality of the product;
  • Accidents, collisions, impacts, falls, drops, or external forces;
  • Misuse, abuse, negligence, overloading, or improper operation;
  • Failure to follow the owner's manual, safety instructions, maintenance requirements, or recommended operating procedures;
  • Improper maintenance or failure to perform the required user maintenance;
  • Improper storage or storage under unsuitable conditions;
  • Exposure to extreme temperatures, including freezing temperatures or excessive heat;
  • Exposure to fire, excessive heat, or other abnormal environmental conditions;
  • Corrosion or damage resulting from exposure to salt water;
  • Corrosion or damage resulting from inadequate rinsing after use in salt water;
  • Damage caused by high-pressure cleaning equipment, including pressure washers or high-pressure water jets;
  • Damage caused by sand, dirt, debris, foreign objects, or obstruction resulting from improper use or maintenance;
  • Unauthorized repairs, modifications, alterations, disassembly, or adjustments;
  • Installation or use of parts, accessories, batteries, chargers, or components not approved by RUSH WAVE;
  • Improper installation or use of replacement components;
  • Damage caused during transportation or storage;
  • Damage resulting from inadequate packaging during transportation;
  • Products whose identification number or serial number has been removed, altered, damaged, or rendered illegible;
  • Claims submitted more than 30 days after the defect or issue was discovered.

Warranty coverage does not apply to maintenance, inspection, troubleshooting, or repair costs when the reported issue is determined not to be covered by this warranty.

4. UNAUTHORIZED REPAIRS AND MODIFICATIONS

Any repair, modification, alteration, adjustment, or disassembly performed on a RUSH WAVE product by a person or company not authorized by RUSH WAVE may void the warranty to the extent that such work causes, contributes to, or affects the reported defect, performance, safety, or reliability of the product.

Any modification made without prior written authorization from RUSH WAVE, or any repair performed using parts or components not approved by RUSH WAVE, may result in denial of the related warranty claim.

This warranty does not cover failures or damage resulting from improper installation, improper repair, unauthorized modification, improper use of components, or failure to perform normal and required maintenance.

5. USER MAINTENANCE AND SALT-WATER USE

No periodic technical service or mandatory visit to an authorized service center is required solely to maintain warranty eligibility, unless otherwise specified in the applicable owner's manual.

However, the customer is responsible for performing the routine inspections and maintenance procedures specified in the owner's manual.

Following each use, the user should, as applicable:

  • Visually inspect the propulsion system and ensure that the impeller, turbine, or other water intake areas are free of obstructions;
  • Check connectors and accessible electrical connections for sand, dirt, debris, moisture, corrosion, or other contamination;
  • Thoroughly rinse the product with fresh water after every use in salt water;
  • Use only low-pressure water when rinsing the product;
  • Never use a pressure washer or high-pressure water jet to clean the product;
  • Dry the product appropriately before storage;
  • Store the product in a dry and suitable environment, protected from excessive heat, freezing temperatures, direct sunlight, and moisture.

Use in salt water is permitted when the product is designed and approved for such use.

However, corrosion, electrical damage, or other damage resulting from salt-water exposure, inadequate rinsing, improper drying, or failure to follow the recommended maintenance procedures is not covered by this warranty.

6. BATTERY USE, STORAGE, AND HANDLING

The customer must follow all battery safety, charging, storage, transportation, and handling instructions contained in the applicable RUSH WAVE owner's manual.

The customer must, in particular:

  • Never leave the battery exposed to direct sunlight, excessive heat, or another heat source for an extended period;
  • Remove the battery from the product after use when instructed by the owner's manual;
  • Store the battery in a dry location under the temperature conditions specified by RUSH WAVE;
  • Follow the recommended state-of-charge requirements for long-term storage;
  • Use only an approved RUSH WAVE charger and compatible equipment;
  • Never use or charge a battery showing signs of physical damage, swelling, leakage, corrosion, overheating, abnormal behavior, or other signs of failure;
  • Never attempt to open, modify, repair, or disassemble the battery.

Damage or failure resulting from improper charging, improper storage, excessive heat, freezing temperatures, physical damage, water intrusion, unauthorized battery modification, use of an incompatible charger, or improper handling is not covered by this warranty.

7. SHIPPING AND TRANSPORTATION COSTS

The customer is responsible for all shipping and transportation costs associated with warranty service.

When a product must be returned for inspection or repair, the customer is responsible for:

  • Arranging and paying for shipment of the product to the designated service location;
  • Properly packaging and protecting the product to prevent damage during transportation;
  • Providing all required documentation for shipment;
  • Paying applicable return shipping costs after the service has been completed;
  • Paying applicable insurance, customs duties, taxes, brokerage, handling, or other transportation-related charges.

RUSH WAVE may assist the customer in identifying the nearest authorized service center or service provider. Such assistance does not transfer responsibility for transportation or related costs to RUSH WAVE unless expressly agreed otherwise in writing or required by applicable law.

Warranty service will normally be performed only after the product has been received and inspected by RUSH WAVE or an authorized RUSH WAVE service provider.

8. WARRANTY CLAIM PROCEDURE

To initiate a warranty claim, the customer must contact RUSH WAVE or an authorized RUSH WAVE retailer or service provider and provide the information reasonably required to evaluate the claim.

A valid proof of purchase, such as the original invoice or receipt, may be required to verify the warranty period and eligibility.

RUSH WAVE may request photographs, videos, diagnostic information, serial numbers, product information, maintenance records, or other documentation before authorizing a return or repair.

The customer must provide accurate information regarding the circumstances in which the defect or damage occurred.

Once the complete product has been received, RUSH WAVE will inspect and assess the warranty claim within a maximum period of 30 days, where reasonably practicable. This period may be extended where additional testing, inspection, technical analysis, information, parts, or other circumstances require additional time.

If, following inspection, RUSH WAVE determines that the reported issue is covered by this warranty, the applicable warranty remedy will be provided in accordance with this policy.

If RUSH WAVE determines that the issue is not covered by this warranty, the customer may be provided with an estimate for the applicable diagnostic, parts, labor, repair, and return transportation costs.

No non-warranty repair will be performed without the customer's authorization.

9. PRODUCT DAMAGE, ACCIDENTS, AND IMPROPER USE

This warranty does not cover damage resulting from an accident, collision, impact, fall, misuse, abuse, negligence, improper operation, or operation outside the conditions specified in the owner's manual.

The customer acknowledges that the use of an electric surfboard or electric kart involves inherent risks, including but not limited to falls, collisions, personal injury, property damage, water-related hazards, and damage to the product.

The customer is responsible for operating the product safely and in accordance with all applicable laws, regulations, safety instructions, and operating limitations.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY REPLACES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Nothing in this warranty is intended to exclude, restrict, or limit any consumer rights, statutory warranties, or other rights that cannot legally be excluded, restricted, or waived under applicable law.

To the maximum extent permitted by applicable law, RUSH WAVE shall not be liable for incidental, indirect, special, or consequential damages, including loss of use, loss of income, loss of business, loss of productivity, or other economic losses resulting from the use of, inability to use, repair, or failure of the product.

RUSH WAVE's obligations under this warranty are limited to the warranty remedies expressly described herein, subject to any mandatory rights and remedies provided by applicable law.

11. GOVERNING LAW

THIS WARRANTY SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE PROVINCE OF QUEBEC, CANADA, SUBJECT TO ANY MANDATORY CONSUMER PROTECTION LAWS OR OTHER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.

12. CUSTOMER ACKNOWLEDGEMENT

By purchasing or using a RUSH WAVE product, the customer acknowledges that they have had the opportunity to review the applicable owner's manual, safety instructions, and warranty terms.

The customer understands that failure to follow the operating, maintenance, storage, charging, and safety requirements may result in damage that is not covered by this warranty, subject to applicable law.

RUSH WAVE reserves the right to determine whether a reported defect or damage is covered by this warranty based on its inspection and technical assessment.
