RUSH WAVE guarantees its new products against all manufacturing or material defects under normal working conditions. Please see below for the full details of our warranty policy.
The 'original owner' is defined as the person or entity who purchased a product from an authorized retailer as evidenced by the original invoice.
The warranty is transferable from one user to another, provided that the new purchaser has a copy of the original invoice.
RUSH WAVE offers a 2-year warranty on all electric surfboards and electric kart. The warranty is 1 years for commercial use.
Accessories are also guaranteed for a duration of 2 years.
This warranty covers structural components and all other components of the products from the date of delivery of the product to the end customer.
Any defective part must be retained for subsequent inspection. Failure to return these parts upon request by RUSH WAVE will automatically void the warranty claim. Replaced or repaired parts will be warranted for the remaining duration of the warranty of the product on which they were installed or repaired, or for the warranty period of those parts, if applicable. The product's warranty period cannot be extended due to non-use caused by repair, demonstration, inspection, or return from rental.
RUSH WAVE's only obligation under this warranty is limited, at its discretion, to the repair or replacement of the product at no cost, either at RUSH WAVE's facilities or one of its authorized retailers. All transportation costs are the responsibility of the customer. Unless otherwise written, this warranty does not serve as a guarantee of performance or productivity.
RUSH WAVE reserves the right to make changes or improvements to its products without any obligation to its customers. For any modification or improvement, when a repair or replacement claim is made, RUSH WAVE will not be required to make these modifications or improvements but may do so, at its discretion, at the customer's expense, on the product or parts already sold.
Exclusions
This warranty, in its entirety, does not cover maintenance and wear parts and consumable products of RUSH WAVE models, including but not limited to lubricating greases and oils, filters, or any other part showing evidence of negligence, overload, abuse, accident, improper maintenance, storage, or use, or unauthorized alteration. No warranty claim applies in the following cases:
a) Product damaged while in transit or storage
b) Cost of transporting the product or part for inspection and/or repair;
c) Costs incurred for repairs made at a supplemental hourly rate;
d) Problem searching and diagnosis;
e) Costs for the use of the same product when the original product is under warranty repair;
f) Costs incurred by communications and transportation when the product is under warranty repair;
g) Product on which the identification number or serial number has disappeared.
This warranty will be voided if a repair or alteration is made to a RUSH WAVE product by a person or company not first approved by RUSH WAVE and which, in RUSH WAVE's opinion, affects the performance and/or reliability of the product in any way.
Any modification made to a RUSH WAVE product without the authorization of RUSH WAVE and/or repair made with parts not first approved by RUSH WAVE will automatically void this warranty. This warranty will not be valid for any problems resulting from improper installation or use of parts or components or a lack of normal and proper maintenance.
THIS WARRANTY REPLACES ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, WRITTEN OR ORAL, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
THIS WARRANTY WILL BE APPLIED AND INTERPRETED ACCORDING TO THE LAWS AND BUSINESS PRACTICES OF THE PROVINCE OF QUEBEC, CANADA.
RUSH WAVE cannot be held responsible for any damage, whether accidental or due to operator negligence, and it is understood that this warranty is the only right and remedy of the customer or user.
